Welcome to ReFind! These Terms of Service ("Terms") govern your access to and use of the ReFind mobile application and website at https://www.refindapp.com/ (collectively, the "Service"), operated by ReFind ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy. We may update these Terms from time to time, and your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Eligibility & Account Registration

You must be at least 13 years old to use ReFind. If you are between 13 and 17, you may only use the Service with the consent and supervision of a parent or legal guardian. You must be at least 18 years old to sell items on ReFind.

When you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access.

3. The ReFind Marketplace

ReFind is a peer-to-peer marketplace platform that enables users to buy and sell pre-owned women's clothing and accessories. ReFind is not a party to any transaction between buyers and sellers. We do not own, possess, inspect, or control the items listed on the platform. We are not an auctioneer, consignment shop, or traditional retailer.

All transactions are directly between buyers and sellers. ReFind facilitates the connection and provides tools for listing, payment processing, and communication, but we do not guarantee the quality, safety, legality, or accuracy of any listing.

4. Buying on ReFind

When you purchase an item on ReFind, you are entering into a transaction directly with the seller. By placing an order, you agree to pay the listed price plus any applicable shipping costs.

Before purchasing, review the listing details carefully, including photos, description, size, condition, and shipping costs. If you have questions, message the seller before buying.

You may submit offers on listings. Offers are non-binding until accepted by the seller. Once an offer is accepted and payment is processed, the transaction is binding.

5. Selling on ReFind

By listing an item for sale, you represent and warrant that you own the item (or have the right to sell it), that the item matches your listing description, and that the sale complies with all applicable laws.

Sellers are responsible for setting accurate prices, providing truthful descriptions and photos, responding to buyer inquiries, shipping items promptly after a sale, and packaging items appropriately for transit.

ReFind charges a 13% service fee on each sale, calculated on the item subtotal (excluding shipping). This fee is deducted before the remaining amount is released to the seller. Seller payouts are processed via Stripe Connect. You must set up a Stripe Connect account to receive payouts.

6. Prohibited Items & Conduct

The following items are prohibited on ReFind: counterfeit or replica items, stolen goods, items that violate intellectual property rights, hazardous materials, weapons, drugs, or controlled substances, items that are illegal to sell in your jurisdiction, and non-clothing items unless explicitly permitted.

The following conduct is prohibited: harassment, threats, or abusive behavior toward other users, creating fake accounts or listings, manipulating reviews or ratings, circumventing the payment system to avoid fees, scraping, crawling, or automated access to the Service, spam or unsolicited commercial messages, and any activity that violates applicable law.

We reserve the right to remove any listing or content and suspend or terminate any account that violates these rules, at our sole discretion.

7. Shipping & Delivery

Sellers are responsible for shipping sold items to buyers. Sellers set their own shipping costs, which are displayed on each listing. Free shipping is at the seller's discretion.

Sellers must ship items within the timeframe specified or within 7 business days of the sale. Sellers should provide tracking information when available.

ReFind is not responsible for items lost, damaged, or delayed during shipping. Shipping disputes should first be addressed between buyer and seller.

8. Returns, Refunds & Disputes

If an item is significantly not as described, damaged during shipping, or a counterfeit, the buyer may open a dispute. Disputes must be filed within 3 days of delivery.

ReFind will review disputes and may mediate between buyer and seller. We reserve the right to issue refunds, partial refunds, or deny claims at our discretion. Refunds, when issued, will be processed to the original payment method.

Items that are accurately described and simply unwanted by the buyer are generally not eligible for return. We encourage buyers to review listings carefully before purchasing.

9. Payments & Fees

All payments are processed securely through Stripe. By making a purchase, you authorize ReFind and Stripe to charge your selected payment method for the total amount of your order.

Buyers pay the item price plus shipping. Sellers receive the item price minus the 13% ReFind service fee. The service fee covers platform operations, payment processing, customer support, and ongoing development.

Seller payouts are processed via Stripe Connect and are subject to Stripe's processing times and requirements. ReFind is not responsible for delays caused by Stripe or your financial institution.

10. User Content

You retain ownership of content you post on ReFind, including listing photos, descriptions, profile information, and messages. By posting content, you grant ReFind a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and promoting the Service.

You are solely responsible for the content you post. You represent that your content does not infringe any third-party rights, is not fraudulent or misleading, and complies with these Terms and applicable law.

We may remove any content that violates these Terms or that we find objectionable, without prior notice.

11. Intellectual Property

The ReFind name, logo, app design, and all associated trademarks, service marks, and trade dress are the property of ReFind. You may not use our intellectual property without prior written consent.

The Service and its original content (excluding user content) are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service.

If you believe your intellectual property rights have been infringed by content on ReFind, please contact us at support@refindapp.com with a detailed description of the alleged infringement.

12. Privacy

Your privacy is important to us. Our collection, use, and sharing of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

13. Limitation of Liability & Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

ReFind does not warrant that the Service will be uninterrupted, secure, or error-free. We do not guarantee the accuracy, completeness, or reliability of any content or listings on the platform.

To the maximum extent permitted by law, ReFind's total liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amounts you paid to ReFind in the six months preceding the claim, or (b) one hundred dollars ($100).

ReFind shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill.

14. Indemnification

You agree to indemnify, defend, and hold harmless ReFind and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, your content, or your transactions with other users.

15. Account Suspension & Termination

We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms, fraudulent activity, or extended inactivity.

You may delete your account at any time through the app settings or by contacting us. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect.

If your account is terminated while you have pending transactions, we will make reasonable efforts to facilitate completion of those transactions.

16. Dispute Resolution

If you have a dispute with ReFind, you agree to first attempt to resolve it informally by contacting us at support@refindapp.com. We will attempt to resolve the dispute within 60 days.

If informal resolution is unsuccessful, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration, conducted on an individual basis. You agree to waive any right to participate in a class action or class-wide arbitration.

Arbitration shall be administered in accordance with applicable arbitration rules. The arbitrator's decision shall be final and binding. Either party may seek enforcement of the arbitration award in any court of competent jurisdiction.

You may opt out of the arbitration agreement by sending written notice to support@refindapp.com within 30 days of creating your account.

17. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the app or via email. Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.
